Terms & Conditions — Tatum Louise LLC

Please read these Terms & Conditions ('Terms') carefully before using our website or placing an order. By accessing our site or making a purchase, you agree to be bound by these Terms. If you do not agree, do not use our site.


1. Eligibility

Our website is intended for users who are 18 years of age or older. By using our site, you represent that you are at least 18 years old. Use of our site by persons under the age of 13 is prohibited.


2. Products & Orders

We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent, involve unusual quantities, or are placed in violation of these Terms. Product descriptions, images, and pricing are subject to change without notice. We make reasonable efforts to display colors and details accurately, but we cannot guarantee that your device's display matches the actual product.


3. Pricing & Payment

All prices are listed in U.S. dollars (USD) and are subject to change. Applicable sales tax will be calculated and displayed at checkout based on your shipping address and our tax obligations under applicable state law. We accept the following payment methods: major credit and debit cards, PayPal, Apple Pay, and Google Pay. Payment is processed by our third-party payment processors and is subject to their terms.


4. Shipping & Fulfillment

We ship within the United States only. Orders are fulfilled through our third-party warehouse partner (InSync Fulfillment). Estimated shipping timelines are provided at checkout and are estimates only — we are not liable for carrier delays.

Risk of loss and title for items purchased from us transfer to you upon delivery to the carrier. Once your order is handed off to the carrier, it is your responsibility to track the shipment using the tracking number provided.

Lost in Transit

If your tracking information shows a package as delivered but you have not received it, or if your shipment appears lost in transit, please contact us at hello@tatumlouise.com within 10 days of the expected delivery date. We will work with the carrier to investigate. If the carrier confirms the package as lost, we will reship your order or issue a full refund at our discretion. We are not responsible for packages confirmed as delivered by the carrier to the address provided at checkout.


5. Returns & Refunds

We want you to be satisfied with your purchase. Our return policy is as follows:

  • Returns are accepted within 15 days of the delivery date.

  • Items must be unused, unwashed, and in original condition with all tags attached.

  • To initiate a return, contact us at hello@tatumlouise.com with your order number and reason for return.

  • Once your return is received and inspected, we will notify you of approval or rejection.

  • Approved refunds will be processed to your original payment method within 7 business days of inspection completion.

Original shipping costs are non-refundable unless the return is due to our error (e.g., wrong item sent, defective product).


6. Final Sale Items

Items marked as 'Sale,' 'Final Sale,' or 'As-Is' are not eligible for return, exchange, or refund unless they arrive damaged or defective.


7. Damaged or Defective Items

If you receive a damaged or defective item, please contact us at hello@tatumlouise.com within 5 days of delivery with your order number and photographic evidence of the damage. We will replace the item or issue a full refund at our discretion.


8. Chargebacks & Payment Disputes

We encourage you to contact us at hello@tatumlouise.com before initiating a chargeback or payment dispute with your bank or card issuer. Many issues can be resolved quickly through direct communication. We reserve the right to contest chargebacks that we believe are filed without a legitimate basis. Accounts associated with fraudulent chargeback activity may be restricted from future purchases.

Nothing in this section limits your rights under applicable card network rules or consumer protection laws.


9. Intellectual Property

All content on our website — including text, graphics, logos, images, product designs, and software — is the property of Tatum Louise LLC or its licensors and is protected by U.S. copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written consent.


10. Prohibited Uses

You agree not to use our site or services to:

  • Violate any applicable law or regulation

  • Engage in fraudulent or deceptive conduct

  • Purchase products for unauthorized resale or commercial distribution

  • Attempt to gain unauthorized access to our systems or data

  • Transmit any harmful, offensive, or disruptive content


11. Disclaimer of Warranties

OUR WEBSITE AND PRODUCTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TATUM LOUISE LLC'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.


13. Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, labor disputes, supply chain disruptions, carrier failures, or internet outages. We will notify you of any material delay and make reasonable efforts to fulfill your order as soon as practicable.


14. Dispute Resolution — Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our site — including the interpretation, breach, termination, or validity thereof — shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

  • Arbitration will be conducted in Cook County, Illinois, or via videoconference at the election of either party for claims under $10,000.

  • The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

  • Filing fees and arbitration costs are the responsibility of the party initiating the claim, per the AAA Consumer Arbitration Rules. Each party is responsible for its own attorneys' fees.

  • Either party may seek emergency injunctive relief in a court of competent jurisdiction to preserve the status quo pending arbitration.

CLASS ACTION WAIVER: YOU AND TATUM LOUISE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.

If the class action waiver is found unenforceable, the arbitration agreement shall be null and void with respect to that claim only, and that claim shall proceed in court.

This arbitration provision does not apply to claims that may be brought in small claims court, or to claims involving intellectual property rights.


15. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles. To the extent any claim is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.


16. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted with a revised Effective Date. Your continued use of our site after any changes constitutes acceptance of the updated Terms.
